Intermex Wire Transfer, LLC takes your privacy very seriously. Together with its subsidiaries, Intermex Wire Transfer, Corp. and Intermex Wire Transfer II, LLC, as well as any subsidiary, affiliate or authorized service provider of Intermex, including any successor and assign (collectively, “we”, “us”, “our”, or “Intermex”) is committed to protecting your privacy and security. This Privacy Policy (the “Policy”) explains what personal information we collect about you, with whom we share it, and how you may exercise certain rights with respect to your information. 

This Policy applies to all Intermex online  interfaces,  including  websites,  mobile applications, and all internet-based applications, as well as all such online interfaces associated with any Intermex subsidiary, affiliate, or authorized service provider (collectively, all such online interfaces are referred to as the “Sites”).  This Policy also applies to all Services we offer you at our stores or physical locations. 


The Policy is written in the English language, and to the extent any translated versions of the Policy conflict with the English language version of the Policy, the English language version shall control.  Please note that your use of the Sites is also subject to our Website Terms of Service. Capitalized terms not otherwise defined herein shall have the meanings set forth in Intermex’s Service User Agreement.

This Policy is subject to change.   Please review it periodically.   Your use of the Sites and Services following any such changes means that you accept the revised Policy.  Intermex may provide links to other online interfaces not covered by this Policy.   If you visit or access your accounts from another site, please review the online privacy practices of that site to understand how your online information may be collected, used, and shared.  By using the Sites or using our Services, you agree to the terms and conditions of this Policy, and any subsequent revised Policy.

Our privacy practices with respect to financial products and services are subject to Intermex’s Consumer Privacy Notice provided at the end of this Policy, which may provide choices in the use and sharing of information, and supersedes this policy in the event of any conflict.

I. INFORMATION WE COLLECT AND RECEIVE 

“Personal Information” means personally identifiable information, which can include categories of information such as your name, mailing address, email addresses, telephone, fax or mobile numbers, or account numbers. We may collect the following information about you, your Recipient, or your Beneficiary, which may include non-public Personal Information:

• Identifiers, the information that you provide us in the course of using the Service, such as your name, mailing address, email address and telephone number(s). We may also collect certain sensitive information from you, including your bank account number, credit or debit card number, date of birth and social security number. 
• Information that you provide us in the course of your participation in various partner promotional programs. 
• Third party personal information from you or your mobile device’s address book, such as your Beneficiary or Recipient’s full name, mailing address, email address and telephone number. We may also collect sensitive financial information from you about a Beneficiary or a Recipient, including billing account numbers and account balances held at service companies and bank account and routing numbers. 
• Information about your usage of the Site, including your transaction history, how you use the Site to send or receive transactions, and whom are your Beneficiaries or Recipients. 
• Information that we lawfully obtain from third parties, such as service companies, social media platforms, identity verification services, electronic database services and credit reporting agencies. 
• Information that we indirectly obtain from you, such as information about the device, hardware and software you use when accessing the Site, operating system version, your IP address, pages on our websites that you access, pages of other websites that you visited prior to accessing our websites, etc. We may combine this automatically collected log information with other information we collect about you. 
• We collect personal information on your online activity as described in the paragraph    below titled “COOKIES AND INTERNET TECHNOLOGY.” 
• Recordings of your communications with our Customer Service department, including telephone calls, chatbots, and electronic communications.

If you provide us with information regarding another individual, you represent that you have the person’s consent to give us their information and to permit us to use it in accordance with this Policy.

II. WHY WE COLLECT INFORMATION 

We may use this personal information for the following business purposes: 
• to operate, manage, and maintain our business, 
• to provide our Sites and Services to you, and 
• to accomplish our business purposes and objectives, including, for example, using personal information to develop, improve, repair, and maintain our products and Services and to fulfill your requests; personalize, advertise, and market our products and Sites; conduct research, analytics, and data analysis; maintain our property; undertake quality and safety assurance measures; conduct risk and security control and monitoring; detect and prevent fraud; perform identity verification; perform accounting, audit, and other internal functions, such as internal investigations; to carry out corporate transactions, such as mergers, joint ventures or acquisitions; comply with law, legal process, and internal policies; maintain records; and exercise and defend legal claims. 

Note: In our efforts to provide our Sites, we may occasionally send you push notifications through our mobile Sites, including marketing messages and other Service or Transaction-related notifications that may be of importance to you. You may at any time opt-out from receiving these types of communications by turning them off at the device level through your settings.

We may also share information in an anonymized or aggregate manner for many purposes such as research, analysis, modeling, marketing, and improvement of our Sites.

III. HOW WE COLLECT INFORMATION COOKIES & INTERNET TECHNOLOGY

Cookies are a commonly-used web technology that allow websites to store and retrieve certain information on a user’s system, and track users’ online activities. We, together with vendors we use, may collect information about your use of our Services by such automated means, including but not limited to cookies, pixels, SDKs and other similar technologies.

Cookies and similar technologies can help us automatically identify you when you return to our Services. Cookies help us review website traffic patterns, improve the Services, and determine which Services are popular. We can also use such information to deliver customized content and advertising to users of the Services whose behavior indicates that they are interested in a particular subject area.

When you use the Services, the information we may collect by automated means includes, for example:
• Usage Details about your interaction with our Services (such as the date, time, and length of visits, and specific pages or content accessed during the visits, search terms, frequency of the visits, referring website addresses);
• Device Information including the IP address and other details of a device that you use to connect with our Services (such as device type and unique device identifier, operating system, browser type, mobile network information, and the device's telephone number); and
• Location information where you choose to provide the Services with access to information about your device’s location.

We may also ask advertisers or other partners to serve ads or services to you, which may use cookies or similar technologies placed by us or the third party. If a user does not want information collected through the use of cookies, most browsers allow the visitor to reject cookies, but if you choose to decline cookies, you may not be able to fully experience the interactive features our Services provide. We may share non-personal information obtained via cookies with our advertisers and affiliates. Because there is not yet a consensus on how companies should respond to web browser-based do-not-track (“DNT”) mechanisms, we do not respond to web browser-based DNT signals at this time.

Software Technologies:  We and our third party partners may employ software technology called clear gifs, images, and scripts that help us better manage content on our websites by informing us of what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages or HTML-based emails and are about the size of the period at the end of this sentence.  From time to time, we may also tie cookies, clear gifs, images and scripts to personal information for reasons such as analysis, security, content generation or marketing. If you would like to opt-out of emails, including those with clear gifs, see “Choices You Can Make about Our Use of Your Information” below. 

Tools Used to Develop and Analyze Use of the Sites:  We may use various analytics tools in order to develop and analyze our customers’ use of the Sites. Analytics companies may access anonymous data (such as your identifier for advertising or device identifier) to help us understand how the Sites is used. They use this data solely on our behalf. They do not share it except in aggregate form; no data is shared as to any individual user. If you wish to opt-out of Google Analytics tracking, please visit https://tools.google.com/dlpage/gaoptout. Mobile Analytics Software:  We may use mobile analytics software to allow us to better understand the functionality of our mobile software on your mobile device. This software may record information such as how often you use the mobile applications, the events that occur within the mobile applications, aggregated usage and performance data, and from where the mobile application was downloaded. We may link the information we store within the analytics software to any personal information you submit within the mobile applications. 

Our website may be linked to or from third party websites. Intermex is not responsible for the content or privacy practices of websites that are linked to or from our website. 


IV. INFORMATION SHARED WITH OTHERS

We do not currently “sell” or plan to “sell” personal information we collect except as provided herein or otherwise with your permission to do so. For purposes of this Privacy Policy, “sell” means the disclosure of personal information for monetary or other valuable consideration to another business or a third party for monetary or other valuable consideration. However, we do share personal information with third parties for the business purposes we have described in this Privacy Policy. This includes sharing personal and/or sensitive information about you, your Recipient or your Beneficiary (including nonpublic personal information) with: 

• Third-party service providers under contract with Intermex that help us with our business operations, such as IT services, payment and Transaction processing, fraud prevention, and marketing. Intermex only allows these third party service providers to use personal information for specified purposes and in accordance with Intermex’s instructions and compliance requirements. 
• Third-parties that we partner with to offer additional products and services, such as gift cards or loyalty points, but only when you elect to participate and/or to receive information about those additional products and services.
• Some of our third party advertising vendors or partners show our ads on sites across the Internet. These third parties may use cookies to serve ads based on your visit history to our websites. You may opt out of use of cookies by third parties by visiting http://www.aboutads.info/choices. 
• In the event of the sale, acquisition or merger of some or all of our assets, personal information about you, your Recipient or your Beneficiary might be a part of the transferred assets. We will notify you in the event of such an occurrence and inform you of any choices you may have regarding your personal information, by placing a notice on our websites. 
• Law enforcement, government officials or other third parties, but only in connection with a formal request, subpoena, court order or similar legal procedure: when we believe in good faith that disclosure is necessary to comply with the law, prevent physical harm or financial loss, report suspected illegal activity, or to investigate violations of our Service User Agreement or Website Terms of Service.

Note that we do not share your text message program enrollment or consent with third parties for their own purposes.

Where appropriate, we will limit sharing of your information in accordance with the choices you have provided to us and consistent with applicable law.

V. YOUR PRIVACY CHOICES

We offer you certain choices about what information we collect from you, how we use and disclose the information, and how we communicate with you.
• Marketing Emails: From time to time, we may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. You may choose not to receive marketing emails from us by clicking on the unsubscribe link in the marketing emails you receive from us. Even if you opt out of receiving such communications, we will continue sending you non-marketing email communications, such as administrative or transaction alerts, or information about changes to our Terms.
• Text messages: If you affirmatively consent to receive text messages from us and enroll in such a program, you will receive updates via text unless you opt-out of the text message program. These messages may be unencrypted. Message frequency may vary based on the Services. If at any time you would like to stop receiving text message notifications, please text “STOP” in reply to our message, we will send you a reply message to confirm that you have been unsubscribed and you will no longer receive messages from us. If you want to join again, just sign up as you did the first time and we will start sending messages to you again. If at any time you forget what keywords are supported, just text “HELP” back to us and we will respond with instructions on how to use our service as well as how to unsubscribe.
• Cookies: Web browsers may offer users the ability to disable receiving certain types of cookies; however, if cookies are disabled, some features or functionality of our Services may not function correctly.
• Device settings: Your device may enable you to disable certain permissions or functionality in our Apps (e.g., location); however, when necessary permissions or functionality are disabled, some features or functionality of our website may not function correctly. You can also disable pop-up notifications in device settings.


VI. CHOICES ABOUT YOUR INFORMATION UNDER THE CONSUMER PRIVACY NOTICE

Information we collect from or about individuals in connection with any financial products or services may be subject to applicable federal and state financial privacy laws including the Gramm-Leach-Bliley Act (GLBA) and Fair Credit Reporting Act (FCRA). We therefore use and share any information that we collect from or about customers of such financial products or services consistent with the disclosures in our Consumer Privacy Notice provided at the end of the Policy and, in the event that state privacy law provides for an exemption for GLBA-regulated organizations or information, state privacy law may not apply. 

In particular federal and state law allow you to restrict the sharing of your personal information in certain instances. However, these laws also state that you cannot restrict other types of sharing. Because we have chosen to refrain from certain types of data sharing, the only type of sharing of your personal information that you may restrict is as follows:

• You may also opt-out from promotional messages to you by accessing your preferences under “Manage My Profile.”


VII. OTHER STATE-SPECIFIC PRIVACY NOTICES AND RIGHTS

In addition to the privacy rights that may be exercised in accordance with our Consumer Privacy Notice as described in Section VI above, you can access, modify, delete or update certain personal information submitted on our Sites by logging in to your account and changing your preferences or by contacting Intermex Customer Service at 1-800-670-8611. We will respond to your request within a reasonable timeframe. Please note that we may need you to provide additional information to verify your identity before processing a request. Once verified, we will respond to requests as required by law and otherwise in our discretion.

Note that in some instances, we may decline to honor your privacy request where an exception applies under applicable law, or where we are otherwise legally entitled to do so.
You may appeal our decision in response to any privacy request by contacting Intermex Customer Service at 1-800-670-8611. Please provide detailed information about your request, and why you believe our response was inappropriate and/or inconsistent with applicable laws.
We will not discriminate against you for exercising any privacy rights available to you under applicable privacy laws.

VIII. DATA RETENTION AND DELETION 

We will retain your information, including but not limited to your payment source information and personal information about you, your Recipient, or your Beneficiary, as needed to provide our Services and address other business needs, as required by applicable law, to resolve disputes and to enforce our agreements. Intermex abides by strict security standards, but if you wish to stop using Intermex’s Service, please contact Intermex Customer Service at 1-800-670-8611. 


IX. CONFIDENTIALITY AND SECURITY 

We endeavor to maintain physical, technical and procedural safeguards that are designed to meet applicable laws and protect your personal information against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. We also endeavor to restrict information access to our employees, agents and representatives that need to know it. For example, we employ a number of industry standard practices to protect information you submit to us on our Sites, use encryption technology to protect your sensitive information transmitted on our Sites, and require a username and password from each user who wants to access his or her information on our Sites. However, no method of transmission over the Internet, or electronic storage is 100% secure. Therefore, we cannot guarantee and hereby disclaim its absolute security.

We will make any legally required disclosures in the event of any compromise of personal information. To the extent the law allows us to provide such notification via e-mail or conspicuous posting on the Services, you agree to accept notice in that form.


X. INFORMATION OF MINORS AND CHILDREN 

We do not permit or knowingly engage in the collection of personal information from children under 13 online, and we will endeavor to promptly delete such information upon discovery. 


XI. THIRD PARTY SITES 

Our Sites may contain links to other websites. Intermex is not responsible for the privacy practices or the content of these other websites. We encourage you to familiarize yourself with the privacy practices of these other websites prior to submitting your personal information to them. Our Sites may include social media features, such as the Facebook Like button, and widgets, such as the Share button or interactive mini-programs that run on our websites. These features may collect your IP address, which page you are visiting on our Sites, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Sites. Your interactions with these features are governed by the privacy policy of the company providing it.

XII. INTERNATIONAL DATA TRANSFERS AND USE

Our Sites are controlled and operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than those of the United States or where we expressly engage in business operations. Any information you provide through use of the Sites may be stored and processed, transferred between and accessed from the United States and other countries which may not guarantee the same level of protection of personal information as the one in which you reside. However, we will handle your personal information in accordance with this Policy regardless of where your personal information is stored or accessed.
